Banter Automotive of East Wichita is paying a hefty fine after admitting to allegations brought against them in a consumer complaint. Banter must now pay $15,000 in civil penalties, address safety recalls, and operate with proper licensing as well as warranty documents.

The Sedgwick County District Attorney’s office advises consumers to check safety recalls before buying a vehicle. You can do that online at this website.

Judge William Woolley entered a consent judgment on February 27, 2019. Banter Automotive and the District Attorney’s office agreed to the fine, to address safety recalls in the future, and to maintain proper licensing as well as warranty documents. They also had to compensate the consumer, who purchased a vehicle advertised as having a “Clean CarFax.” The District Attorney found that advertisement to be false as the car was subject to a safety recall.

The District Attorney’s office reminds consumers that, in the Used Car Rule, Buyers Guides are required to be placed on used vehicles being sold by car dealers. These guides provide consumers with purchasing and warranty information.
