No charges yet in Lucas Hernandez case

His stepmother has been released from jail

WICHITA, Kan. - District Attorney Marc Bennett says no charges will be filed this week in the death of 5-year-old Lucas Hernandez.

Bennett gave a brief statement Wednesday afternoon between court cases.  In the statement, Bennett said the investigation is still ongoing and they are still awaiting the full autopsy reports, as well as the results of the toxicology report.

Meanwhile, Emily Glass, the stepmother of Lucas Hernandez was released from the Sedgwick County Jail.  She was being held on a charge of obstruction of justice since last week, when she led a private investigator to the body of Lucas Hernandez in rural Harvey County.   Glass was escorted by her attorney from the jail just after 4 p.m. Wednesday, and she walked silently to a minivan without answering questions from reporters.  

Bennett stressed that the case is still under investigation and his office will continue to work with law enforcement until the case is resolved.
