Arrest made in Chase County shooting incident

Emporia police officers have arrested a 38-year-old Milford man in connection with a shooting that happened along a state highway.

The man was arrested Tuesday after he was released from a hospital.   He was booked into the Lyon County jail for aggravated battery, three counts of aggravated assault, a firearms charge and for circumvention of an ignition interlock device.

The man is accused of shooting at an SUV on Kansas Highway 150 on the morning of May 13th, injuring a 33-year-old Emporia man.   Three other men were in the SUV at the time.   The injured man was treated and later released from a hospital.

The Kansas Bureau of Investigation said the four men in the SUV were carpooling to work from Emporia on a trip to McPherson.  They passed an SUV that appeared to be broken down on the side of the road, and they heard loud bangs.  That’s when the rear right side passenger realized he had been shot.

Officers searched the area around the stopped SUV and did not find anyone. They searched the surrounding pasture and found the 38-year-old suspect face down and unconscious in a creek.  They revived him and took him to an Emporia hospital.   Officers also found a handgun in the creek.

The KBI is working with Chase County sheriff’s investigators on the case.
