A Sedgwick County district judge has denied a motion for a new sentencing hearing for two brothers convicted in the murders of five people in Wichita.

Jonathan Carr appeared in court Monday morning, while his brother Reginald waived his court appearance.

The Carrs were convicted in the murders of five people during a crime spree in Wichita in December, 2000.   They were convicted in the deaths of Jason Befort, Brad Heyka, Heather Muller and Aaron Sander during a home invasion in east Wichita.  They were also convicted in the death of Ann Walenta during a robbery attempt and the robbery of another person.

The Carrs were sentenced to death in 2002, and last year the U.S. Supreme Court refused to hear their appeal.  That exhausted their direct appeals in the case, but now they have moved to indirect appeals.

Sedgwick County District Attorney Marc Bennett argued that the district court had no reason to re-sentence the brothers because the Kansas Supreme Court has already upheld the convictions and sentences.

District Judge Jeffrey Goering denied the motion for resentencing, and the attorneys for the Carr brothers indicated they would appeal that ruling.
