As police in Derby crack down on the possession of a substance known as Delta-8, Sedgwick County District Attorney Marc Bennett has issued a statement on the legality of the product.
In a written statement issued Thursday, Bennett quoted a Kansas Attorney General’s ruling from 2021 that Delta-8 or Delta-8 THC is a controlled substance that has more than .3 percent total tetrahydrocannabinols, or THC. Bennett said his office has had questions from local law enforcement agencies about the product. He said local law enforcement is working to educate the community on the potential criminal liability for the possession or distribution of the product.
Bennett said law enforcement will investigate and present his office with evidence of Delta-8 possession, and his office will review those cases and file charges when appropriate. He said “It is our hope that businesses and others who advertise, market or sell “Delta-8″ or other controlled substances will take this opportunity to stop and conform to the laws of our state.”
